BECAUSE YOU REQUIRE QUALITY, QUICKLYU.S. Reg. No. 5,528,833May 15, 2015Class 9Federal registration term ran through February 14, 2025. The slogan remains in continuous commercial use. Common-law rights established by that use since 2015 remain fully enforceable.

“Technologies” is disclaimed in U.S. Reg. No. 7,771,162. The distinctive 1X element is protected standing alone and as used in 1X Technologies.

Pending Applications and Common-Law Use in Additional Classes

In addition to its federally registered rights in Class 9, 1X Technologies LLC has continuously used the 1X™, 1X® TECHNOLOGIES, and 1XTECH® family of marks since May 15, 2015 in connection with goods and services in International Classes 7, 35, 38, 40, 41, and 42 under common law. Applications are pending before the United States Patent and Trademark Office to register the marks in those additional classes. Those common-law and pending federal rights are enforceable under applicable law.

Family of Marks

1X Technologies LLC enforces a family of marks built around the distinctive “1X” element. This family includes:

  • the federally registered mark 1X TECHNOLOGIES (U.S. Reg. No. 7,771,162). Because “technologies” is disclaimed, the distinctive “1X” element is the protected portion of that registration.
  • the coined mark 1XTECH® (U.S. Reg. No. 7,771,161), a fanciful mark formed by combining “1X” with “Tech”
  • 1X has continuously used 1X, 1X TECHNOLOGIES, and 1XTECH as house marks on its goods and services since May 15, 2015

Because the distinctive “1X” element is protected, 1X also has rights in marks that combine “1X” with descriptive or generic terms (such as “Innovations,” “Flex,” “Speedpack,” or similar wording), with the descriptive portion subject to disclaimer. This family of marks strengthens protection for the 1X brand across a wide range of goods and services.

1X Technologies LLC is the exclusive licensed user of this family of marks and the senior continuous user in the United States since May 15, 2015. 1X is the only party authorized to manufacture, brand, sell, license, sublicense, and enforce these marks in commerce.

IV. DISTINCTIVE TRADE DRESS

1X Technologies LLC enforces distinctive trade dress used in connection with 1X products and marketing. That trade dress includes a consistent high-tech robotics and humanoid motif and the 1X Blue Aesthetic (electric royal to deep navy/teal), with cyan/blue-green, bright electric green, white, red, black, and metallic/gray accents.

The identity is anchored by patriotic motifs, including the 1X America 250 Logo with the Wyoming cowboy and American eagle, the 1X Superpatriot Logo with American flag elements, the 1XTECH logo with integrated American flag, the 1X Blue Planet Logo, and the Made in the U.S.A. Premium Quality flag logo.

These elements are source identifiers under 15 U.S.C. § 1127. Use of this combination of color, motif, and presentation on competing robotic, cable, connector, or consumer-electronic products in a manner likely to cause confusion is trade-dress infringement under 15 U.S.C. § 1125(a).

V. THE 1X™ PROTECTED ECOSYSTEM

The 1X brand covers a vertically integrated ecosystem of goods and services. 1X Technologies LLC, as exclusive licensee and senior user, asserts and enforces rights across the following domains.

A. Semiconductors, Microprocessing & Integrated Intelligence

1X™ designs and supplies smart, integrated products that incorporate microprocessing, AI capability, and software. These include audio speakers, amplifiers, audio and video decoders, power conversion and inversion devices, cables, connectors, and processor-based control systems.

Because 1X™ has continuously sold smart versions of its federally registered Class 9 goods since 2015 — products in which semiconductor chips, Systems-on-Chip (SoCs), Neural Processing Units (NPUs), AI capability, and embedded software function as integral components — 1X asserts common-law rights in the microprocessing and AI technology that enables those smart products.

Any chip, processor, SoC, NPU, or microprocessing module sold or branded under the 1X™ or 1XTECH® marks in connection with smart audio systems, consumer electronics, power devices, cables, connectors, or control systems falls within this ecosystem. Replacement chips and modules sold to support or repair 1X™ products are likewise treated as integral components of those goods.

B. Advanced Wire, Cable & Electronics

Torsion-resistant cable-management systems, robotic dress packs, energy chains, electric wire harnesses for vehicles and robotics, power-distribution units, copper coil windings (magnet wire), AI data-center cabling, shielded control cables, high-flex robotic cables, high-voltage and extra-high-voltage power cable, aerospace and spaceflight interconnects, submarine and subsea cable systems, and custom-manufactured electrical interconnects.

C. Robotics & Autonomy

Industrial and factory automation robots, including multi-axis and 6-axis arms, collaborative robots, SCARA, delta, Cartesian, and gantry robots; machine-tending, welding, palletizing, and pick-and-place cells; controllers, motor drives, PLCs, VFDs, HMIs, sensors, end-of-arm tooling, dress packs, and cable-management systems; mobile, inspection, and field platforms, including AMRs, AGVs, ground service units, cable- and facility-inspection robots, quadrupeds, aerial and drone systems, undersea and ROV systems, floating-solar and offshore support robots, and outdoor service robots such as robotic lawnmowers; defense and weapons-system robotics, unmanned systems, and aerospace ground-support equipment used with prime contractors and authorized defense customers.

Consumer and residential robotics, including humanoid robotic systems, robotic vacuums, household and smart-home service robots, wearable and assistive robotic devices, and the audio, display, camera, sensor, and control electronics sold with those systems; charging docks, battery-swap and recharge stations, tether and shore-power interfaces, wireless charging modules, and related charging infrastructure; navigation, vision, force, and environmental-sensing modules. Unauthorized use of the 1X® Technologies or 1XTECH® marks on these systems, or on the cables, connectors, electronics, or charging products that enable them, is infringement of the rights described in this notice.

D. Electronics & Audio

Audio speakers, audio amplifiers, audio receivers, electrical audio and speaker cables and connectors, audio decoders, video decoders, smart-home hubs, home-automation platforms, consumer-electronic devices, power-conversion devices, power converters, power inverters, and home-networking modules.

This protection extends to any product that incorporates or functions as audio speakers, amplifiers, audio receivers, microphones, audio/video decoders, or power-conversion devices, whether or not the product also has additional capabilities.

E. Consumer Electronics & Smart-Home Use

Certain 1X products — including audio speakers, home-automation hubs, residential cabling, and integrated smart-home systems — are designated consumer electronics and are intended to comply with FCC Part 15 when used as supplied. Unauthorized modification, including jailbreaking AI hubs, overriding speaker limiters, or tampering with safety protocols, voids warranties and releases 1X from liability for the resulting condition.

F. Consumer Electronics, Audio & Interactive Voice-Activated Devices

U.S. Reg. Nos. 7,771,161 and 7,771,162 cover consumer electronic products, namely audio amplifiers, audio speakers, audio receivers (microphones), electrical audio and speaker cables and connectors, audio decoders, video decoders, speakers, power-conversion devices, power converters, and power inverters.

Any product marketed as, or functioning as, a consumer-electronics device with audio capability — including products that recognize voices, play music or video on integrated displays, capture photos or video through embedded cameras, respond to verbal commands, or integrate with connected ecosystems — falls within the scope of those registered goods. This protection applies to any assembly or hardware platform including these products, regardless of additional capabilities or functions.

Audio functionality, video display, camera input, AI capability, and software integration in such products are not incidental. They are central to design, marketing, and consumer appeal as interactive voice-activated consumer-electronics devices.

G. Software, Firmware, Downloadable Applications & AI Systems

1X has continuously designed, manufactured, and sold consumer electronics and robotics systems since May 15, 2015. Many of those products are software-defined and require embedded software, firmware, and user-facing applications to function.

The federally registered Class 9 marks cover audio speakers, amplifiers, audio receivers (microphones), electrical audio and speaker cables and connectors, audio decoders, video decoders, power-conversion devices, power converters, power inverters, and home-networking modules, and any assembly or hardware platform including these products — all of which operate through embedded software and firmware.

Because 1X has continuously used the 1X™, 1X® TECHNOLOGIES, and 1XTECH® marks in connection with software-integrated consumer electronics and robotics since 2015, 1X asserts senior common-law rights in Class 9 for downloadable software, mobile applications, firmware, and AI systems that relate to or enable those goods.

This protection extends to any software, firmware, or AI system that enables or is integrated into products falling within the registered Class 9 goods, including smart consumer electronics, audio systems, and processor-based control systems that incorporate AI capability.

No third party may use the 1X™,  1X® TECHNOLOGIES, or 1XTECH® marks, or any confusingly similar designation, on downloadable software, mobile applications, firmware, AI models, or cloud services that enable, control, or interact with consumer electronics, audio products, robotics, or automation systems without authorization from 1X Technologies LLC.

H. Smart Cables, Intelligent Connectors & Physical-Layer Infrastructure

Smart cables and intelligent connectors are a protected part of the 1X ecosystem. They are the physical and data-transmission layer that enables 1X microprocessors, AI systems, sensors, and software-defined electronics to function.

1XTECH® smart cables and intelligent connectors are engineered for advanced sensing, diagnostics, and, in certain configurations, localized processing. They maintain signal integrity under extreme mechanical stress, high flex-cycle counts, and demanding environments, including industrial robotics, inspection systems, marine and subsea use, aerospace, and spaceflight.

These products are not commodity wire. They are purpose-built interconnects that carry power, data, and diagnostic intelligence between processors, sensors, and actuators.

Because 1X has continuously used the 1X® TECHNOLOGIES and 1XTECH® marks on advanced wire, cable, and interconnect solutions since 2015, and because those products are integral to registered Class 9 goods, including processor-based control systems, audio/video decoders, and home-networking modules, they fall within the protected ecosystem.

Unauthorized use of the 1X™, 1X® TECHNOLOGIES, or 1XTECH® marks on smart cables, intelligent connectors, wire harnesses, energy chains, or related interconnect products is infringement of federally registered and common-law rights.

VI. PRIVATE LABEL & CUSTOM MANUFACTURE

1X Technologies LLC operates as a custom manufacturer and as exclusive licensed user of the 1X family of marks. Products branded 1X™, 1X® TECHNOLOGIES, or 1XTECH® — including cables, connectors, harnesses, electronics, modules supplied as part of 1X™ products, robotic sub-assemblies, software, firmware, AI models, and consumer-electronic devices — are manufactured, branded, and sold by 1X™ as exclusive licensee, regardless of the physical point of origin or contract-manufacturing facility.

No third party may manufacture, assemble, or distribute any product bearing the 1X™ family of marks without written authorization from 1X Technologies LLC. Any product bearing these marks without that authorization is unauthorized and, where the legal standard is met, counterfeit, regardless of country of origin, manufacturer, or quality.

Sale of a physical unit does not transfer any right in the marks, software, firmware, designs, or other intellectual property, except the limited software sublicense stated in the 1X™ Terms and Conditions of Sale.

VII. REVERSE ENGINEERING

Software, firmware, and hardware designs embedded in 1X™ products — including robotic architectures, AI hardware configurations, proprietary circuitry, custom cable constructions, actuator-control logic, and embedded code — are proprietary to the 1X™ business and may be used only as authorized by 1X Technologies LLC as exclusive licensee.

Reverse engineering, decompiling, disassembling, competitive teardown, or other design extraction directed at 1X robotic platforms, AI hardware, semiconductors supplied as part of 1X products, software, or proprietary circuitry is prohibited except to the limited extent a statute expressly forbids that restriction, and constitutes misappropriation of trade secrets where applicable law so provides.

VIII. NON-CONFORMING GOODS & COMPOSITE INFRINGEMENT

Any product, electronic equipment, robotic system, hardware component, module, software application, or autonomous unit branded “1X,” “1XTECH,” or “1X Technologies” — regardless of form factor — that does not originate from 1X Technologies LLC, or that is not authorized by 1X, is a non-conforming good and a misrepresentation of origin.

This includes, without limitation, any robot or consumer-electronic device that:

  • is manufactured, assembled, or sold by anyone other than 1X under the 1X name or a confusingly similar variant
  • contains speakers, amplifiers, wiring harnesses, connectors, power supplies, processors, or networking modules branded with the 1X mark that were not sourced from or authorized by 1X
  • is marketed or sold through any channel using 1X, 1XTECH, or 1X Technologies without authorization
  • runs software, firmware, or an operating system that identifies itself with the 1X mark without authorization
  • creates reverse confusion or other marketplace confusion between verified 1X offerings and unauthorized hardware or software

Because 1X™ manufactures and holds federal registrations for essential Class 9 components used in modern electronic and robotic architecture — including audio, power, data-transmission, and related systems — rights extend to finished systems that incorporate those components and are sold under the 1X family of marks. A finished product assembled from protected components and sold under the marks without authorization is itself an infringing good.

1X Technologies LLC disclaims all liability for performance, safety, defects, injury, data loss, or operational failure of unauthorized systems sold by unaffiliated parties. Anyone who purchases, operates, or relies on goods falsely identified as 1X™ does so at that party’s own risk.

IX. CONSTRUCTIVE NOTICE & WILLFUL INFRINGEMENT

Federal registration of the live marks provides constructive notice nationwide under 15 U.S.C. § 1072. This page is actual notice of the full scope of rights asserted by 1X, including registered trademarks, common-law marks, pending applications, registered copyrights, and distinctive trade dress.

Infringement after the date of this notice may be treated as intentional, knowing, and willful, and may subject the infringer to available remedies, including:

  • treble damages under 15 U.S.C. § 1117(b)
  • statutory damages of up to $150,000 per copyrighted work under 17 U.S.C. § 504(c)(2)
  • disgorgement of profits under 15 U.S.C. § 1117(a)
  • attorney’s fees and costs under 15 U.S.C. § 1117(b) and 17 U.S.C. § 505
  • seizure and destruction of counterfeit goods under 15 U.S.C. § 1118
  • injunctive relief under 15 U.S.C. § 1116 and 17 U.S.C. § 502

1X monitors the marketplace for unauthorized use, reverse confusion, and related brand harm. 1X reserves all remedies against manufacturers, distributors, retailers, investors, and any party that knowingly facilitates or benefits from infringement.
