The following marks are the exclusive property of 1X Technologies LLC as the exclusive licensee and senior user. All rights are reserved. Unauthorized use is strictly prohibited and will be enforced to the fullest extent of the law.

Additional Unregistered Work (Common Law Copyright Asserted) 1X Technologies 2016 Robotics Cable Advertisement (feat. Atlas Humanoid) — first published 2016, continuous use. The overall advertisement, its original composition, and its use in commerce under the “1X” brand are the exclusive intellectual property of 1X Technologies LLC under common law copyright.

IV. DISTINCTIVE TRADE DRESS

1X Technologies LLC owns and vigorously enforces its Distinctive Trade Dress, defined by a consistent theme of high-tech robotics and humanoid motifs and the “1X Blue Aesthetic” (Electric Royal to Deep Navy/Teal), used alongside our original Cyan/Blue-Green and key accents of Bright Electric Green, White, Red, Black, and Metallic/Gray. This identity is anchored by Pervasive Patriotic Motifs, including the “1X America 250 Logo” with the Wyoming Cowboy and the American Eagle, the “1X Superpatriot Logo” with American Flag elements, the 1XTECH logo with integrated American Flag, the “1X Blue Planet Logo,” and the “Made in the U.S.A. Premium Quality” flag logo.

These elements are inherently distinctive, non-functional, and serve as Arbitrary Source Identifiers under 15 U.S.C. § 1127, distinguishing our authentic U.S.-origin goods from all foreign-backed imitations. Any use of this color scheme and motif combination on competing robotic or consumer electronic products constitutes trade dress infringement under 15 U.S.C. § 1125(a).

V. THE “1X” PROTECTED ECOSYSTEM

The “1X” brand covers a comprehensive, vertically integrated ecosystem spanning multiple trademark classes and product categories. Our rights extend across the following domains:

A. Semiconductors, Microprocessing & Integrated Intelligence (Class 9)

1X Technologies LLC designs and supplies smart, integrated Class 9 products that incorporate advanced microprocessing, AI capability, and software integration. These include audio speakers, amplifiers, audio and video decoders, power conversion and inversion devices, cables, connectors, and processor-based control systems.

Because 1X Technologies LLC has continuously sold smart versions of its federally registered Class 9 goods since 2015 — products in which semiconductor chips, Systems-on-Chip (SoCs), Neural Processing Units (NPUs), AI capability, and embedded software function as integral components — we possess strong common law rights in connection with the microprocessing and AI technology that enables these smart products.

Any chip, processor, SoC, NPU, or microprocessing module sold or branded under the 1X® or 1XTECH® marks in connection with smart audio systems, consumer electronics, power devices, cables, connectors, or control systems falls within the scope of our protected ecosystem. Replacement chips and microprocessing components sold to support or repair 1X® registered Class 9 products are likewise protected as integral components of those goods.

B. Advanced Wire, Cable & Electronics (Classes 7 & 9)

Torsion-resistant cable management systems, robotic dress packs, energy chains, electric wire harnesses for automobiles and robotics, power distribution units, copper coil windings (magnet wire), AI data center cabling infrastructure, shielded control cables, high-flex robotic cables, and custom-manufactured electrical interconnects.

C. Robotics & Autonomy (Class 7)

Humanoid robotic systems, industrial 6-axis robotic arms, collaborative robots (cobots), quadruped robots, aerial and ground mobile service units (drones, AMRs), autonomous floating solar or undersea systems, wearable robotics interfaces, autonomous navigation modules, and smart environmental sensors.

D. Electronics & Audio (Class 9)

Audio speakers, audio amplifiers, “Boom Box” systems, audio receivers, electrical audio and speaker cables and connectors, audio decoders, video decoders, smart home hubs, home automation platforms, consumer electronic devices, power conversion devices, power converters, power inverters, and home networking modules comprising electronic components and associated wiring.

This protection expressly extends to any product that incorporates or functions as audio speakers, amplifiers, audio receivers, audio/video decoders, microphones, or power conversion devices, whether or not such product also possesses additional capabilities or functions.

E. Consumer Electronics & Smart Home Use (Class 9)

Certain 1X products—including Audio Speakers, Home Automation Hubs, Residential Cabling, and integrated Smart Home systems—are designated as Consumer Electronics. These devices are designed to comply with FCC Part 15 regulations for residential use. Modification of 1X Consumer Electronics (including “jailbreaking” AI hubs, overriding speaker limiters, or tampering with safety protocols) voids all warranties and releases 1X Technologies LLC from all liability.

F. Consumer Electronics, Audio & Interactive Voice-Activated Devices (Class 9)

Our U.S. Reg. Nos. 7,771,161 and 7,771,162 explicitly cover “Consumer electronic products, namely, audio amplifiers, audio speakers, audio receivers (microphones), electrical audio and speaker cables and connectors, audio decoders, video decoders, speakers, power conversion devices, power converters, and power inverters.”

Any product that is marketed as, or functions as, a consumer electronics device with audio capability — including products that recognize voices, play music or video content on integrated display screens, capture photos or video through embedded cameras, respond to verbal commands, or integrate with smart home or connected ecosystems — falls directly within the scope of our federally registered Class 9 goods. This protection applies to any assembly or hardware platform including these products, regardless of whether the product also possesses additional capabilities or functions.

The audio functionality, video display, camera input, AI capability, and software integration of such products are not incidental; they are central to the product’s design, marketing, and consumer appeal as an interactive voice-activated consumer electronics device.

G. Software, Firmware, Downloadable Applications & AI Systems (Class 9)

1X Technologies LLC has continuously designed, manufactured, and sold consumer electronics and robotics systems since May 15, 2015. Many of these products — including audio speakers, smart home hubs, connected devices, and processor-based systems — are software-defined and require embedded software, firmware, and user-facing applications to function.

Our federally registered Class 9 marks (U.S. Reg. Nos. 7,771,162 and 7,771,161) cover audio speakers, amplifiers, audio receivers (microphones), electrical audio and speaker cables and connectors, audio decoders, video decoders, power conversion devices, power converters, power inverters, and home networking modules (and any assembly or hardware platform including these products) — all of which operate via embedded software and firmware.

Because 1X Technologies LLC has continuously used the “1X” and “1XTECH” marks in connection with software-integrated consumer electronics and robotics since 2015, we possess senior common law rights in Class 9 for downloadable software, mobile applications, firmware, and AI systems that relate to or enable our registered goods.

This protection extends to any software, firmware, or AI system that enables or is integrated into products falling within our registered Class 9 goods, including smart consumer electronics, audio systems, and processor-based control systems that incorporate AI capability.

No third party may use the “1X” or “1XTECH” marks (or any confusingly similar designation) in connection with any downloadable software, mobile application, firmware, AI model, or cloud-based service that enables, controls, or interacts with consumer electronics, audio products, robotics, or automation systems without authorization from 1X Technologies LLC.

H. Smart Cables, Intelligent Connectors & Physical Layer Infrastructure (Classes 7 & 9)

Smart cables and intelligent connectors constitute a critical and protected component of the 1X® ecosystem. These products serve as the physical and data transmission layer that enables the full functionality of 1X® protected semiconductors, microprocessors, AI systems, and software-defined electronics.

1XTECH® smart cables and intelligent connectors are engineered to support advanced microprocessing and AI capability. They incorporate embedded sensing, diagnostics, and in certain configurations, localized processing capabilities that support real-time data exchange between protected chips and the sensors, actuators, and subsystems they control.

These cables and connectors are not commodity components. They are purpose-engineered to maintain signal integrity under extreme mechanical stress, high flex-cycle counts, and demanding environmental conditions. By doing so, they directly enable the performance of 1X® protected AI models, firmware, and software systems that rely on clean, uninterrupted data flow from sensors and to actuators.

Because 1X Technologies LLC has continuously used the 1X® and 1XTECH® marks in connection with advanced wire, cable, and interconnect solutions since 2015, and because these products are integral to the operation of our registered Class 9 goods (including processor-based control systems, audio/video decoders, and home networking modules), they fall squarely within our protected ecosystem.

Any unauthorized use of the 1X® or 1XTECH® marks on smart cables, intelligent connectors, wire harnesses, energy chains, or related interconnect products constitutes infringement of our federally registered and common law trademark rights.

VI. PRIVATE LABEL & CUSTOM MANUFACTURER STATUS

1X Technologies LLC operates as both a Custom Manufacturer and a Private Label Brand Authority. Products branded “1X,” “1X Technologies,” or “1XTECH”—including but not limited to Chips, Processors, SoCs, AI Compute Modules, Cables, Connectors, Harnesses, Robotic Sub-Assemblies, Software, Firmware, AI Models, and Consumer Electronic Devices—are the exclusive property of 1X Technologies LLC, regardless of the physical point of origin or contract manufacturing facility.

No third party may manufacture, assemble, or distribute any product bearing the “1X” family of marks without the express written authorization of 1X Technologies LLC. Any product bearing these marks without authorization is counterfeit, regardless of its country of origin, the identity of the manufacturer, or the quality of the goods.

VII. REVERSE ENGINEERING PROHIBITION

All software, firmware, and hardware designs embedded in 1X products—including but not limited to robotic chassis architectures, AI hardware configurations, proprietary circuitry, neural processing pathways, custom cable lay lengths, actuator control logic, and embedded code—remain the sole and exclusive property of 1X Technologies LLC. Reverse engineering, decompiling, disassembling, teardown analysis for competitive purposes, or any other form of design extraction applied to any 1X robotic chassis, AI hardware, semiconductor, software, or proprietary circuitry is strictly prohibited and constitutes misappropriation of trade secrets under state and federal law.

VIII. WARNING: NON-CONFORMING GOODS & COMPOSITE INFRINGEMENT

Any product, electrical & electronic equipment, robotic system, electronic device, hardware component, semiconductor, AI module, software application, or autonomous unit branded “1X”—regardless of form factor (humanoid, quadruped, industrial, mobile, aerial, undersea, or consumer electronic)—that does not originate from 1X Technologies LLC, or that does not contain our certified Class 9 components (Audio, Data, Power, or Actuation systems), constitutes a Non-Conforming Good under the Lanham Act and a material misrepresentation of origin.

This includes, without limitation, any robot or consumer electronic device that:

• Is manufactured, assembled, or sold by any entity other than 1X Technologies LLC under the “1X” name or any confusingly similar variant;
• Contains internal components such as speakers, amplifiers, wiring harnesses, connectors, power supplies, SoCs, or networking modules branded with the “1X” mark or any confusingly similar variant that were not sourced from 1X Technologies LLC;
• Is marketed or sold through any channel using the “1X” name, the “1XTECH” name, the “1X Technologies” name, or any confusingly similar variant without authorization;
• Runs software, firmware, or an operating system that identifies itself with the “1X” mark without authorization; or
• Creates Algorithmic Fusion or Reverse Confusion in the marketplace between 1X Technologies LLC’s verified offerings and unverified hardware.

Because 1X Technologies LLC manufactures and holds federal registrations for the essential Class 9 components that comprise a significant portion of modern electronic and robotic architecture—including the power distribution, sensory, data transmission, processing, and actuation systems—our rights extend to finished systems that incorporate those components. Any finished product assembled from our protected components and sold under our marks is itself a counterfeit good.

1X Technologies LLC expressly DISCLAIMS ALL LIABILITY for the performance, safety, defects, damages, injuries, data loss, operational failure, or any other consequences (including third-party claims) arising from the use of any unauthorized systems sold by unaffiliated entities. We assume no responsibility for products falsely identified as “1X.” Any person or entity purchasing, operating, or relying upon such unauthorized goods does so entirely at their own risk.

IX. CONSTRUCTIVE NOTICE & POST-NOTICE WILLFUL INFRINGEMENT

Federal registration of our marks provides constructive notice of our rights nationwide under 15 U.S.C. § 1072. No party may claim ignorance of these rights. This notice serves as actual notice of the full scope of our intellectual property portfolio, including our registered trademarks, common law marks, registered copyrights, and distinctive trade dress.

Any infringement occurring after the date of this notice will be deemed intentional, knowing, and willful and will subject the infringer to the enhanced remedies listed below, including but not limited to:

• Treble damages under 15 U.S.C. § 1117(b);
• Statutory damages of up to $150,000 per copyrighted work under 17 U.S.C. § 504(c)(2);
• Disgorgement of all profits derived from the infringement under 15 U.S.C. § 1117(a);
• Attorney’s fees and costs under 15 U.S.C. § 1117(b) and 17 U.S.C. § 505;
• Seizure and destruction of counterfeit goods under 15 U.S.C. § 1118;
• Preliminary and permanent injunctive relief under 15 U.S.C. § 1116 and 17 U.S.C. § 502.

1X Technologies LLC actively monitors the global marketplace for Algorithmic Fusion, Reverse Confusion, Internet Shadowing, and any other form of unauthorized use. We reserve the right to pursue all available remedies against all infringing parties, including manufacturers, distributors, retailers, investors, and any entities that knowingly facilitate or benefit from the infringement.
